Is it your business plan to build as much as possible right now?
Yes, because people have bought from us. We owe it to them to keep the process going to be able to get on site as soon as possible.

Wouldn’t you rather focus on completing ongoing and sold-out projects than announcing new ones?
Most definitely. Projects like Smart Heights for example are due to be finished this year. The two towers in Jumeirah Lake Towers (JLT) are completed – Lake Terrace was handed over in the middle of last year and Lake View at the end of last year.

The Crescent was handed over at the end of last year.

Lago Vista is well advanced and we’ve almost finished the concrete work and it’s up to the 16th or 17th floor and will be completed towards the end of this year.

The first two of our shell and core towers in Business Bay are due to finish at the end of this year and will be handed over next year.

We’re already on the 52nd floor of Ocean heights and the structure will be finished in a few months time, so again it will be finished by the end of the year.

I haven’t come across a single Damac investor who has anything good to say about the company.

For the buildings that we’re handing over at the moment – Lake Views in JLT – the customers are generally very happy with what they’re getting. We’ve delivered exactly what we promised. Yes the project was late and no one can deny that. The infrastructure in JLT, which is completely outside our control, is not as completed as it should be.

But in terms of the actual product itself, we have very small snagging lists. They get attended to immediately. In fact we have a process where our customers get the opportunity to come in about 30 days ahead of completion to view their apartment and give us any comment, and then we work on it prior to them moving in. That’s not something every developer does, so perhaps giving people those opportunities means they then comment against us.

One item that did cause a lot of confusion on the Lake View building was the entire issue of the area variations.
Now area variations are something that are provisional of our sales and purchase agreement, so we issued the invoice including the amount for the variations in compliance with the sales and purchase agreement.

Rera came along and advised that there was a law coming out, which in fact said that area variations couldn’t be passed onto customers. We’re thankful for Rera having clarified that. It’s a pity that this hadn’t come out earlier to avoid confusion, but other than that I’m not conscious of anything that has caused what I call ‘letters to the editor’.

What about the whole parking issue?
At the time of purchase of the unit, everyone was given the opportunity to buy a parking bay. But people came back saying “where is my parking bay” – they didn’t buy it! They are now being given the opportunity to buy it again.

Shouldn’t developers have to build responsibly, which includes providing the option of free parking if the investor chooses not to buy one?
We have sufficient parking spaces for people to buy in all our buildings and in the majority of cases people have bought them. We clearly can’t be responsible for what the RTA or the master developer decide to do, or not do in areas outside our jurisdiction.

Do you have any projects that are on hold or have been cancelled?
We have no projects that are on hold or cancelled but yes, we have reset all our priorities in relation to where we have customers who have bought. We are also looking at all our designs to ensure our buildings are as efficient as can be and are resetting our priorities accordingly.

Any news on the Haz Tower?
That is now called Commercial Square and is on the list of ten projects that we will be awarding.

What stage is Palm Springs at?
At the moment we haven’t seen sufficient progress on infrastructure work out there [for it] to make any sense to commence onsite. And we haven’t been offered the plot anyway.

What sort of compensation has been promised to investors of Al Jawharah tower in Jeddah, if it gets delayed?
The project is going ahead.

We’ve awarded the enabling works, which will take around nine to 10 months to complete and whatever provisions are mentioned in the contract will come into play, if it is late in delivery.

So why are your investors so unhappy most of the time?
If a customer doesn’t like an answer that doesn’t mean we’re going to change it. If he doesn’t like the answer and he goes running to the media then that’s for us to decide whether we want to discuss it or not.

Going back to the issue of area variations – at the time, when some of our customers created that, they weren’t creating it because they were aware of a law that we were unaware of – they were creating it because they, in fact, wanted us not to enforce what was in the contract. That’s not something that is open to debate – the contract was quite clear. Subsequently, Rera said that this is what the law is going to be and we said fine. Now, whether we’re happy with that or not, we accepted it.

It looks like you have a special team dedicated to scrutinising contracts and coming up with loop holes to take advantage of?
That’s not the case. The contract is a two-way thing. Both parties to the sales and purchase agreement have rights and both have obligations. And just as we can’t say all we want is our rights and want to ignore our obligations, similarly the other party to that contract, who is the customer, can’t say I want all my rights but I should be able to walk away from my obligations.

If it turns out with the passage of time, that a new law says that the aspects of either parties rights or obligations have to be modified, changed, added to, deducted from or removed, then so be it. Once that’s done we will respect that and we expect the other party of the contract to respect that too.

Do you think it’s fair to charge a 5% land fee on the already agreed sales price?
I don’t know who’s doing that. It’s certainly not us.

no longer to be trusted
Damac have not paid out the correct compensation, FAR FROM IT and regardless of what Damac 'claim the contract says. Also building still not fully complete and verging on dangerous with lifts not working and fire escapes not safe. Incidently another thing you might want to ask Mr Riddoch - it turns out that the apartments were NEVER OVERSIZED IN THE FIRST PLACE so where did the excess area charges come from - TOTAL FRAUD and a diversion so owners were to o busy fighting that cause and not noticing the compensation issue and also too tired to fight that as well. I hope, for Dubai's sake Damac are told to get their 'house in order' by the ruler and we can get the quality of apartment we were promised and expected in Dubai

Fair coverage?
The reporter should do a follow-up interview with a representative of the disgruntled investors to get fair coverage on both sides. Site photos should also show proof of who is really telling the truth. How about it, Mr. Conrad Egbert???

Peter Riddoch needs to open his dictionary again and read the definition of 'ETHICS'. This company is totally unethical and I am an unfortunate owner of one of the units in the Lake View tower. My advice to investors: Stay away from Damac.

Lake View Lies!
I have read all the comments by Peter Riddoch who is very economical with the truth. The reality is that DAMAC bullied me into signing my legal rights away by refusing to hand my keys even when I called the police, they have refused to pay me adequate compensation as per my contract, their building is far from complete despite their blatant lies that Lake View was handed over at end of 2008. Perhaps Mr Riddoch can explain why his company sent letters to ALL investors in MARCH 2009 inviting us to take possession then if he claims Lake View was ready in 2008??? The staff have zero customer service skills and are an extention of theie CEO. What a pathetic disgraceful company. I will never do business with this company.

I think damac are a joke, they try to extract as much money out of people as possible for a bad customer service, bad work, late projects, bullyboy tactics, projects that dont represent what was sold to people. They really bring Dubai's reputation. We wouldnt touch damac again and advise everyone else to run a mile from them

I still dont have my apartment handed over and only yesterday May 17 received an invoice for payment which included the excess area charge. I wish id have bought a cheap and chearful as it was put to me by the estate agents at the time as these apartments turned out to be much higher spec and completed 2 years prior to the clowns at damac! we infact are the idiots handing over our money!

what he says is a load of rubbish. i was involved in the area variation and had to get help from rera. they made them drop this charge as over 400 investors complained they were not going to pay. lake view looks terrible, it is not completed and what was promised was not delivered. our building looks nothing like what we purchased. they have taken all the blue glass and put on their tecom building. we have a white and little blue building. i had 100 snagging issues. i thought it was the law no property can be sold without parking. some people were not allowed to see their units until they had paid area variation, but we got to see because damac so-called security let us in before. its all lies what he is saying he needs to be fired.

'Small Snags'
I was interested to read Peter Riddoch's comment that "we have very small snagging lists." I've had to contend with major electricity, aircon and plumbing problems at my studio in The Crescent, IMPZ ever since I moved in. So what exactly is a 'small snag', I wonder?

Lake View Lies
Lake View was not handed over at the end of last year. DAMAC have still not stated the contractual completion date. There is a lot of building works going on whole floors of apartments, the parking and commercial areas. The fire escapes are a death trap as they are littered with building materials, stair barriers not fully installed, and once inside you cannot escape. DAMAC have not delivered what they promised - this is not luxury and the huge infinity pool turned into a standard small pool. I too am being refused keys because I refuse to sign a letter of discharge that would eliminate all my legal rights to fight this unscrupulous developer.

I was stunned and amazed to read the article relating to Peter Riddoch and Damac Properties. We, as customers, have not been treated with respect, quite the opposite. When Damac feel they would like to reply to our queries, they treat us like common fools, ask us to sign ridiculous items of literature to benefit themselves and leave the client without a leg to stand on - just to get our keys!. All in all, this company do not give Dubai good press and this should be addressed. When investing, many looked at Dubai as a country with vision, class and ethics and Damac do nothing to maintain these standards. Its very sad for the country.

DAMAC's Shameful Lies and Bully Tactics
As an investor at Lake View I am sadly in total agreement with the previous comments. The two and a half year delay and DAMAC's shockingly deceitful interpretation of the contractual compensation clause are just the 'tip of the iceberg' as far as I'm concerned. The building has not been completed to the original high specification or standard is still not complete and there is no evidence of a proper completion certificate as per contract. I do not know of any 'happy' owners, particularly those who have discovered that contractors have been living in their apartments up until hand over! The area variation was a deliberate attempt to hoodwink those who were unaware of the 2008 RERA ruling and we all know that waiting for a refund from DAMAC is like getting blood from a stone! The final straw is indeed when DAMAC are refusing to hand over keys until the letter of discharge has been "voluntarily" signed. This company is a disgrace and I will never invest in DAMAC again!!

Lake View - 28 months late and still not complete
Damac are a company of lies and deceit. Not only has Lake View been 28 months late, they attempted to charge for excess area, which was against the law, and once they were 'forced' to take away the penalties, the owners find that their apartments were never bigger in the first place....surely an illegal act??? And they now refuse to pay the correct compensation...?5000 short of what they owe the purchasers. And they also had workers LIVING in some of the apartments using the cleaning facilities. I could go on and on with all our issues. What started out as an exciting investment has turned out to be a complete nightmare, mainly because Damac seem to have their 'own set of laws' which they use for their financial gain.

DAMAC = lies & blackmail
Lake View was handed over in 2008? That's news to all owners in Lake View. The area variation law is entitled "Article 12 of Law 13 of 2008". The clue is in the title - this law came out before handover and applies to our contract. Even when RERA told DAMAC to take these charges off, DAMAC initially refused. Regardless of the law, DAMAC never provided ANY proof to customers, they just demanded the payment with threats of penalties if payment wasn't made promptly. Late delivery compensation is a joke. Nobody would interpret the clauses as DAMAC have done. An insult to owners intelligence. The final straw is that even if you pay DAMAC all payments plus their unjustified penalties they still won't give you your keys until you "voluntarily" sign a letter of discharge & adherence meaning you have no legal comeback at all. DAMAC are an embarassment to Dubai.
