UAE midday work ban penalties unveiled

UAE Labour Minister Saqr Al Ghobash has announced details of the penalties that will be issued to companies that contravene the midday work ban this summer.

First time offenders will have see their firm downgraded to category C for a period of at least three months, and will be fined US $2700 (AED10,000). A category C firm will not have any work permits processed for at least six months.

Second time offenders will have no work permits processed for six months and will be fined $5400.

The ban will take affect between the hours of 12:30pm and 3:00pm from July 1 through to August 31 inclusive.

Third time offenders have no work permits processed for a year, and will be fined $8200.

The instructions, issued via a ministerial order, also cover daily working hours and overtime payments.

“The resolution sets the daily working time at eight hours in the morning or night shifts,” the order said, “and any extra time within 24 hours the worker stays at [the] work site should be calculated as payable overtime as per the labour law.”

Employers are instructed to provide a shaded area for workers to rest in during the mid-day break.

The resolution also states that employers must post adequate notice of daily work timings “at an obvious place at the work site and provide adequate preventive methods to protect workers from work injuries.”

Works which must continue for technical reasons are exempt from the ban, though the order said “employers are demanded to provide all facilities that cater for the health of workers including first aid, air-conditioners, sunshades and cold water.”

Useless...
This midday work ban is useless!!! YOu all know majority of companies are forcing their labourers to work starting 1pm..if they will implement this kind of ban they should have at least inspect and make sure everybody follows..

What about industries?
We are welcome Midday break. We have confusion regarding other industries like manufacturing & production types. Could you please confirm this matter as soon as possible.

Middday Break -A Welcome Break
As I understand it all Contractors will welcome this break as the pace of Construction has drastically reduced , they would encourage the lobourers to take this break and work more constructively.....

Midday break during summer
I think that summer break rule is possible if each department of UAE might contribute. Bcz implementation is in our hand.Each employer must coordinate and cooperate in this regard and other government bodies must act to implement this system.We have ban on working under sunlight. But the regulation does not clear that workforce either working inside the building during peak summer.This implications has to clarified by government authority.

Midday Break
We believe the midday break must be implemented well ahead of July as now itself its too hot and humid in the UAE, anticipate the strategy will workout this year if the said penalties will be implemented???..again is there adequate inspectors to verify the timing especially in the construction zone? if not a toll free number to report will workout rapidly and the toll free number must be published in all media in different languages.

Middwy work ban
and do you really think all the companies will follow this work ban???? Dubai does not have enough inspectors to see that this ban is working with the result that there will still be companies, who like last year, will not have a ban in their companies. It should be upto the individual working in that particular company to see that a complaint is lodged if the workers are still working in the afternoon.
