America's Caterpillar in trademark tussle with Cat & Cloud cafe
Construction equipment giant reportedly calls for Cat & Cloud cafe to 'cancel' its trademark on footwear and apparel
American construction equipment manufacturer — and owner of the Cat trademark — Caterpillar Inc has sued Californian cafe Cat & Cloud to 'cancel' the use of its trademark on products such as footwear and apparel, according to cafe owners Chris Baca and Jared Truby, who said they had received an initial notice of potential litigation on 4 August, 2018.
According to a report by American coffee blog Sprudge, Caterpillar Inc's manager of corporate media, Rachel Potts, said the original equipment manufacturer (OEM) was "not targeting a small business", nor was it "focused on Cat & Cloud's primary interest", which is the sale of coffee.
“We’ve simply asked the US Trademark Office to remove their trademark registration on footwear and apparel, products for which Caterpillar has longstanding trademarks and a considerable business.”
Caterpillar, according to the Sprudge post, hoped to resolve the issue quickly.
